State appeals against High Court verdict on establishment of Supreme Court Secretariat

The state has filed an appeal against a High Court verdict that directed the establishment of a Supreme Court Secretariat.
Attorney General Barrister Ruhul Quddus Kajal filed the appeal on behalf of the state on Thursday morning.
Earlier, following the final hearing of a writ petition filed by seven Supreme Court lawyers, a High Court bench comprising Justice Ahmed Sohail and Justice Debashish Roy Chowdhury delivered its verdict on September 2 last year.
In its ruling, the court declared the existing Article 116 of the Constitution inconsistent with the Constitution and void, and restored Article 116 of the original 1972 Constitution. The court also directed that an independent and separate secretariat for the Supreme Court be established within three months.
Subsequently, the interim government issued the “Supreme Court Secretariat Ordinance, 2025,” separating the judiciary from the executive branch.
However, the ordinance was later repealed by the BNP government. On May 19, a notification was issued declaring the Supreme Court Secretariat dissolved. Following the dissolution, a total of 15 officials, including the senior secretary of the newly formed secretariat, were transferred back to the Ministry of Law.
