Bail in another case, 'no bar to release' Khairul Haque

Former Chief Justice A.B.M. Khairul Haque has secured interim bail in a case filed with Banani Police Station in Dhaka under charges of attempted murder and the Explosives Control Act during the July uprising.
A High Court bench comprising Justice K.M. Zahid Sarwar and Justice Sheikh Abu Taher issued the order along with a rule on Monday (today), following a hearing on his bail petition.
Following the bail in this case, his lawyer Monayem Nabi Shahin said there is no legal bar to the former chief justice's release from custody.
Earlier, after failing to secure bail in the lower court on July 27, he had filed a bail petition with the High Court yesterday (Sunday).
During the hearing, senior lawyers Md. Monsurul Haq Chowdhury and Motahar Hossain Saju, along with lawyer Monayem Nabi Shahin, appeared for Khairul Haque. Deputy Attorney General Syeda Sajia Sharmin represented the state.
Lawyer Monayem Nabi Shahin said the rule seeks to know why Khairul Haque should not be granted regular bail in this case. He also said the High Court has granted him interim bail until the rule is disposed of. So far, a total of 9 cases have been filed against him, and he has granted bail in eight of them. With the bail in this Banani Police Station case, there is no legal bar to his release.
Khairul Haque served as Chief Justice from September 30, 2010, to May 17, 2011 and he was 19th Chief Justice of Bangladesh. The Appellate Bench led by him delivered a verdict on May 10, 2011, declaring the 13th Amendment to the Constitution void.
On July 24 last year, police arrested him at his Dhanmondi residence in Dhaka. He was later shown arrested in a murder case related to the killing of Jubo Dal activist Abdul Kayum Ahad in Jatrabari, Dhaka, during the July uprising. Since then, he has been in jail in connection with various cases.
After being shown arrested in the Abdul Kayum Ahad murder case, he was shown arrested in several other cases. Following his bail in eight separate cases, the investigating officer filed an application with the court on July 2 to have him shown arrested in the Banani Police Station case. He was shown arrested in this case on July 8.
