Appellate Division stays High Court order barring 'Shown Arrest' without specific case

The Appellate Division has stayed the High Court's ruling that no accused person can be "shown as arrested" without a specific case filed against them. The apex court has also directed the High Court to dispose of the related rule within four weeks.

The Appellate Division bench, led by the Chief Justice, issued the order today (Wednesday, July 29). Earlier, the High Court bench of Justice Razik-Al-Jalil and Justice Debashis Roy Chowdhury had ruled that no one can be arrested without a specific case and had simultaneously issued a rule on the matter.

During today's hearing, Attorney General Barrister Md. Ruhul Quddus Kazal appeared for the state. Senior lawyers Barrister Sara Hossain and Advocate Syed Mamun Mahbub argued on behalf of the petitioner.

While commenting on the matter, Attorney General Mohammad Ruhul Quddus Kazal said the High Court's order risked hindering the independent investigation by the probe agencies. He argued that if such a directive stood, law enforcement agencies would be left with no scope to take action even when they possessed specific evidence against an individual.

He also informed the court that the Appellate Division has set next Sunday as the date for the hearing on the matter of showing former Chief Justice ABM Khairul Haque as arrested in any new case.
